eSign Campaign - Terms and Conditions

About this Document
- These Terms and Conditions (Terms) govern the SMS messaging program operated by Bookipi Pty Ltd (ACN 617 668 185) (we, us, our) in connection with the Bookipi eSign and Payroller eSign e-signature platforms (Platform).
- These Terms apply to all recipients of SMS messages sent by us through the Platform, including document signatories, issuers, and any person copied on a document (each, a Recipient).
- These Terms should be read together with our eSign App Terms and Conditions available at https://bookipi.com/esign-terms-and-conditions/, and our Privacy Policy, available at https://bookipi.com/privacy-policy/. To the extent of any inconsistency between these Terms and the eSign App Terms and Conditions, the eSign Terms and Conditions will prevail.
Programme Description
- We use SMS messaging to send Recipients notifications relating to the Platform. These messages may include:
- requests to review and sign a document;
- reminders that a document is awaiting signature;
- confirmation that a document has been successfully signed;
- notification that a document has been closed and is no longer available for signing; and
- notification that a document has been viewed, signed, declined, or completed (for document issuers).
- SMS messages are sent from Bookipi (for documents sent via Bookipi eSign) or Payroller (for documents sent via Payroller eSign).
Messages
- Message frequency will vary depending on your use of the Platform and the number of documents sent to or by you.
- Message and data rates apply to all SMS messages sent to you from us and from us to you. If you have any questions about your text plan or data plan, please contact your wireless provider.
- Carriers are not liable for delayed or undelivered messages.
Opt-Out
- You may cancel SMS messages from us at any time by replying STOP to any message we send you. After you send STOP, we will send you a final SMS confirming that you have been unsubscribed. After this, you will no longer receive SMS messages from us in connection with this programme. If you wish to re-subscribe, please sign up again the same way you originally opted in.

- Privacy: We collect, hold, use, and disclose your personal information in accordance with our Privacy Policy available at https://bookipi.com/privacy-policy/. Our Privacy Policy sets out how we handle your personal information, how you may access or correct it, and how you make a complaint.
- Consumer Law Rights: Certain legislation, including the Australian Consumer Law (as set out in Schedule of the Competition and Consumer Act 2010 (Cth)) and similar consumer protection laws and regulations, may confer you with rights, warranties, guarantees, and remedies which cannot be excluded, restricted or modified (Consumer Law Rights). Nothing in these Terms excludes your Consumer Law Rights.
- Liability: To the maximum extent permitted by law, we are not liable for any consequential, special, or indirect loss arising out of or in connection with the SMS messaging programme, including, but not limited to, loss of profit, loss of revenue, loss of business, loss of goodwill, or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise. A party’s liability in relation to these Terms will be reduced proportionately to the extent that the relevant liability was caused or contributed to by the acts or omissions of the other party.
- Amendments: We may amend these Campaign Terms at any time if required by any regulatory authority or otherwise at our discretion, by updating this page. Continued use of the Platform following notice of any amendment constitutes acceptance of the amended Terms.
- Governing Law: These Terms are governed by the laws of New South Wales, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
- Disputes: In the event of a dispute, Entrants must contact the Promoter and attempt to resolve the dispute in good faith. If the matter can’t be resolved, either party may refer the matter to a mediator. The costs of the mediation will be shared equally between the parties.
