E-Sign Consent

By clicking “I Accept,” “I Agree,” or any similar button or checkbox, or by using the Bookipi services, you acknowledge that you have read, understood, and agree to be bound by this Electronic Disclosure and Consent agreement (agreement). If you do not agree to receive Communications electronically or do not consent to the terms of this agreement, you must not click-to-accept and you will not be able to open or maintain a Bookipi account or use the Bookipi eSign tool.

Electronic Disclosure and Consent
In this agreement,:

  • “we,” “us,” “our,” and “Bookipi” means Bookipi Pty Ltd (ABN 91 617 668 185), (which operates under both the Bookipi and Bookipay brands). “You” and “your” refer to the business entity signing up for a Bookipi account to use the Bookipi eSign tool.
  • “Bookipi eSign” means Bookipi’s electronic signature solution, integrated within the Bookipi platform and available via web browser and mobile application, through which documents may be uploaded, created, signed, and delivered electronically.
  • “Communications” means disclosures, notices, agreements, fee schedules, privacy policies, statements, records, documents, and other information we provide to you, or that you sign and submit or agree to at our request.

Consent
By clicking to accept this agreement, you agree that you are willing and able to receive Communications in electronic form, and consent to receive Communications in electronic form. If you do not give your consent to receive Communications in electronic and not paper form, you may not open a Bookipi account. If you withdraw your consent to electronic Communications at any point after providing consent hereunder, we reserve the right to terminate your Account.

Delivery Methods
We will deliver Communications to you electronically, either through the Bookipi website https://bookipi.com (“Website”); our mobile Application (“App”); text or SMS messages (“Text Messages”); or through electronic mail (“email”). Where documents require signing, we will deliver them to you via email through Bookipi eSign. Documents will contain designated signing fields (“tags”) indicating where your signature is required. Documents may require signatures from multiple parties, either simultaneously or in a defined signing order.

We may be required by law to deliver certain Communications to you on paper even though you have consented to receive it electronically.

Hardware and Software Requirements
To receive and retain electronic Communications from Bookipi, you will need the following:

  • A computer or mobile device with an operating system that supports everything below;
  • An internet connection;
  • A current version of a web browser that we support, including: Edge version 42 or higher, Firefox version 62 or higher, Safari version 12 or higher, or Chrome version 69 or higher;
  • A hard drive or other method of storing data;
  • A valid, active email address;
  • A current version of a supported web browser capable of accessing and completing the Bookipi eSign tool; and
  • A current version of a program that displays PDF files.

We may update these requirements periodically in order to maintain our ability to provide electronic Communications; if these requirements change in a substantial way, we will notify you of the changes.

If you notify us, or we discover that you are unable to meet the above requirements, we may suspend or terminate your access to your Bookipi account until such time as you are able to meet the requirements. During any suspension period, you will not be able to access your account or conduct transactions, but your account data will be retained. We will work with you to restore access once you can meet the necessary technical requirements.

Updating Contact Information
It is your responsibility to maintain accurate and current contact information so that we may send you electronic communications. You can update your email address and other contact information by logging into your online account, in the “Settings” section, or by emailing us at support@bookipi.com.

Requesting Paper Copies
If we choose to make paper copies of certain electronic Communications available, we do not create any obligation to do so at other times. You may obtain a paper copy of an electronic Communication by printing it.

Communications in Writing
We are required by law to give you certain information in writing. All Communications delivered to you in electronic format will be taken as information delivered “in writing.”

Withdrawing Consent
You have the right to withdraw your consent to this agreement at any time. Withdrawing consent may result in the termination of your Bookipi account, including access to the Bookipi eSign tool. You may withdraw consent by emailing us at support@bookipi.com. If you withdraw your consent and/or terminate your Bookipi account in accordance with our Terms of Service, you will not receive any refunds or credits for prepaid fees.

Governing law and jurisdiction
This agreement is governed by and shall be construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia, and any courts that may hear appeals from those courts, for any dispute arising out of or in connection with this agreement.
